Death penalty posed in kidnap case - "Prospective jurors were brought into the courtroom and questioned five at a time after surviving an initial reduction of the pool last week. The 151 that remained after the first cut said they could sit as fair jurors despite being familiar with the case."

due process guarantees the right to be tried by an impartial jury. it is a constitutional right.

Amendment VI - Right to speedy trial, confrontation of witnesses - In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury...

how can someone familiar at all with the case be totally impartial? it's not possible. i'm bothered by this. let's just say they have the wrong man, just for argument's sake, although the likelihood of this being the case, especially in florida, isn't slim.

here is a town that's been through hell and back. a little girl is abducted and murdered. that's about as upsetting as crime gets. an absolutely horrific crime. not only does it make the local papers, but the story goes global and people around the world cringe in unison as they read about the last terrifying moments of this little girl's life. it's nothing short of disgusting, revolting, there are no words in this language to describe how utterly wrong what occured is.

people who have been subjected to the media and it's portrayal of this story are affected. you'd have to be as cold-blooded as the individual who committed this crime, to not be. unless you're unfamiliar with it.

there is no way that a jury consisting of 12 people who are familiar with this case can be utterly objective, viewing the facts as they are, with no preconcieved notions of guilt whatsoever. there is NO WAY. it's dangerous. if it were an innocent man standing trial for this crime, it would end in tragedy and more loss of innocent human life.

something is seriously wrong with this system, a system that violates the constitional rights of american citizens. a system that picks and chooses the goofiest fucking constitutional rights to uphold and die for (right to bear arms) and completely disregards ones that save lives. and there is something seriously wrong with a nation that will send it's men off to die protecting these constitutional rights when those very same rights are being completely neglected at home.
